Agreement Overview:

This agreement outlines the terms of service that apply to your use of WebZenHost's services, effective from your service activation date. It is crucial to adhere to these terms for a seamless hosting experience. WebZenHost reserves the right to reject additional terms that deviate from the service descriptions outlined in our maintained terms of service.

Domain Rules:

  • Domain Registrations: No refunds are applicable once a domain is registered, including any associated add-ons (Privacy Protection, DNS Management, Premium DNS, etc.).
  • Domain Renewal: WebZenHost sends three reminders before the expiration date, and we are not responsible for delays or failures in renewal. Once renewed, no refunds will be provided.

Domain Infringement:

WebZenHost does not allow the registration or transfer of domains similar to trademarks, companies, banks, government organizations, brands, etc. Any attempt to register such domains may result in immediate suspension without notice, and no refund will be issued.

Bandwidth:

Users exceeding bandwidth limits will be notified, and accounts may be suspended until additional bandwidth is purchased or the service is upgraded.

Uptime Guarantee:

Service interruptions due to scheduled maintenance are not counted towards uptime. WebZenHost is not liable for third-party service failures or delays.

Late Payment or Non-Payment:

Different hosting services have specific payment deadlines, and non-compliance may lead to service suspension or termination.

Account Termination:

Accounts may be terminated due to cancellation requests, non-renewal, suspected fraud, violation of terms, disputes, or chargebacks.

Third-Party Services:

When purchasing third-party services from WebZenHost, customers must agree to the terms of the respective third-party companies.

Price Change:

WebZenHost reserves the right to change pricing details at any time. It is the customer's responsibility to stay updated on pricing changes.

Use of services

1.1 Excessive CPU, bandwidth, or disk space usage can compromise our shared hosting environment. This occurs when system resources, such as disk space and processors, are used beyond the allowances of your specific plan type to the extent that your usage affects the hosting accounts of our other customers.

1.2 Excessive resource usage: CGI scripts or other executable code that consumes an undue amount of CPU time [defined dynamically by WebZenHost at its discretion] will be reprioritized if possible, or we will ask you to discontinue its use permanently or modify the script to operate in a less resource-intensive manner. Failure to cease operation of the offending executable will be considered server abuse. WebZenHost reserves the right to terminate any process it deems to be using excessive resources.

1.3 Background processes: Background processes [applications or utilities that are started from within an interactive shell login and set to run permanently in the background on a server] must not be initiated without prior arrangement with us. We reserve the right to examine all code before it is run on the server. Running background processes without prior arrangement and confirmation in writing from WebZenHost is considered server abuse.

1.4 Pornography: WebZenHost prohibits the storage and transmission (inbound and outbound) of pornography, with the exception of softcore erotic art. Written permission must be obtained before any pornographic material is stored and/or transmitted through WebZenHost servers.

1.5 Copyrighted software, warez, destructive applications, copyrighted media, proprietary computer information, and hacking & cracking sites are strictly prohibited on any portion of our services and network. Customers storing & transmitting (inbound and outbound) files that violate copyright or other federal laws are subject to immediate termination of service.

1.6 Any incident of server abuse is grounds for immediate and unconditional account termination. Common examples of abusive practices are listed below, and WebZenHost reserves the right to interpret what constitutes abusive practices. If you are unsure whether your actions may be perceived as an abuse of service, contact WebZenHost directly to check with us before proceeding.

1.7 Email abuse: Unsolicited Commercial Email ('Spam') is strictly forbidden. This is considered server abuse and is grounds for immediate termination.

1.8 Reselling for free: WebZenHost prohibits any portion of its services from being resold without charge. This includes, but is not limited to, entire hosting accounts, email services, scripts, FTP accounts, MySQL databases, applications, licenses, web space, and bandwidth (including image hosting and file/data hosting services, either free or subscription/fee-based).

1.9 Proxy websites and similar sites are prohibited.

1.10 WebZenHost will not tolerate misuse of space. The space allocated is for website use only and cannot be used for storing files or software not linked to the website.

1.11 Hosting of MP3 files and video files is not allowed.

1.12 File hosting sites or sites primarily designed for downloading content are not allowed on our webspace.

1.13 Bandwidth allocated is only for the website hosted on our server. Using bandwidth for other websites by hotlinking is not allowed.

1.14 Webmail can be used only for temporary storage of emails. We recommend our customers use POP3 to download emails to their own PC. Storing email in webmail is not allowed.

1.15 Hosting of adult sites on our servers is not allowed.

Fair Usage Policy:

If you subscribe to a product that does not have any usage caps or limits, this Fair Usage Policy ("FUP") will apply to your account and all associated services provided with your hosting package.

A Fair Usage Policy is necessary to ensure our hosting services are used fairly and our services operate reliably for all customers. Resources provided on all our hosting services, including but not limited to Reseller Accounts, Web Hosting Accounts, Virtual Private Servers, and Dedicated Servers, are all governed by this Fair Usage Policy.

Our aim is to provide a fair hosting service to all our customers. Therefore, we believe that imposing a specific figure on what we consider to be “excessive” use is not necessarily helpful and may unfairly penalize users. What is deemed excessive will be determined by several factors, including (but not limited to) the length of time your excessive usage continues and the amount of resources being used.

If, in our reasonable opinion, you have breached this FUP, we will contact you by email to let you know that your usage is excessive and is affecting WebZenHost services/systems and/or other users. We reserve the right to impose reasonable limits to reduce your usage and/or pair you with other users utilizing the same or nearly the same amount of usage.

Resources such as MySQL databases, subdomains, POP3 mail accounts, SMTP mail accounts, and FTP accounts should not be used or created in a way that can potentially have adverse effects on the normal optimal operation of our services.

Hosting accounts created should not exceed limits which, in good faith, WebZenHost believes will have adverse effects on the normal optimal operation of our services.

WebZenHost reserves the right to terminate the hosting contract and refuse to renew the service if it considers the client's usage of resources to be violating the fair usage policy of WebZenHost.

Backups

We strongly encourage all of our customers to perform their own backups on their home computers or CDs to ensure you have ready access to your data in the event of a hardware failure. Although we regularly take backups of our server and do not expect such events to occur, we want you to be prepared just in case. Please kindly take backups of all your files.

Even the best, most complete, and redundant backup systems can and do fail for a variety of reasons, despite the best efforts of the web hosting service. THEREFORE, WEBZENHOST DOES NOT GUARANTEE THE AVAILABILITY, COMPLETENESS, CURRENCY, OR INTEGRITY OF THESE BACKUPS OR THE DATA THEY CONTAIN. Consequently, you must not rely on the availability, completeness, currency, or integrity of these backups.

Customers are responsible for maintaining their own backups on their personal computers or other devices.

WebZenHost does not provide any sort of compensation for lost, inaccurate, incomplete, or outdated data in the event that WebZenHost's backups do not function properly, regardless of the reason(s) for any such malfunction, even if the malfunction was due to the fault or negligence of WebZenHost.

Change of TOS:

WebZenHost retains the right to change its terms of service without prior notification. Customers are advised to check for updates periodically.
